Attorney fees
Fee rules can change depending on the kind of claim. A serious work injury may involve more than one kind of case, so the fee question should be explained clearly before anyone signs anything.
In Alabama workers’ compensation cases, attorney fees are generally limited to 15% of compensation awarded or paid, subject to court approval under Ala. Code § 25-5-90. Social Security Disability fees are governed by federal law and are usually based on a percentage of backpay. Retaliatory-discharge and third-party work-crash cases are different, more complicated, and riskier, so fees are usually arranged by a separate contingency-fee contract.
A worker who cannot go back to work may have a workers’ compensation case, a Social Security Disability issue, a retaliatory-discharge issue, or a separate crash claim if another driver or company caused a work-related wreck. Those are not always the same case, and they may not have the same fee rules.
